Cadence is operated by CadenceMusicApp ("CadenceMusicApp", "we", "us"). By creating an account or continuing to use Cadence, you enter into an agreement with CadenceMusicApp on these terms. If you use Cadence on behalf of an organisation, you confirm you have authority to bind that organisation. If you use it as an individual, you confirm you are of legal age in your country.
Cadence is a private service for hosting, streaming and sharing music. Members upload audio (and, on the Studio plan, video) into a personal library or into private invite-only groups, chat about it, and listen together in group sessions. Nothing on Cadence is public: there are no public profiles, feeds or discovery.
We grant you a limited, non-exclusive, non-transferable right to use Cadence within the limits of the plan you have selected.
You must provide accurate information and keep it up to date. You are responsible for keeping your sign-in details confidential and for all activity that happens under your account.
You must not misuse Cadence. In particular, you must not:
You keep ownership of the music and other content you upload. You grant us a limited licence to store, process, transcode and transmit it solely so we can provide the service to you and the members of your groups.
If you believe content on Cadence infringes your rights, contact us using the in-app report button or by email and we will review it. We may remove or restrict content, refuse uploads, and suspend accounts for repeated or serious infringement.
CadenceMusicApp retains ownership of Cadence and everything in it other than member content, including the software, design, documentation and branding.
We work to keep Cadence available and reliable, but we do not guarantee that it will be uninterrupted, error-free or free of data loss. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Cadence Basic is free. Cadence Professional and Cadence Studio are paid monthly subscriptions that renew automatically until cancelled. Prices shown at checkout may have tax added depending on where you are.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Refunds are also described in our Refund Policy.
You can cancel at any time from Settings. Cancellation stops future renewals; you keep paid features until the end of the period you have already paid for, after which your account moves to Cadence Basic.
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends you will have a reasonable window to export your uploads, after which your content may be deleted.
Our aggregate liability arising out of or in connection with the service is limited to the fees you paid in the twelve months before the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
You will indemnify us against claims arising from content you upload, your unlawful use of the service, or your breach of these terms.
We may update these terms; material changes will be notified in the app. You may not assign your agreement without our consent; we may assign ours in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the jurisdiction in which CadenceMusicApp is established, and the courts there have exclusive jurisdiction.
